LAZ Petitions Constitutional Court to Remove Auditor General Over Age and Ratification Issues

The Law Association of Zambia (LAZ) has filed a petition with the Constitutional Court to remove Auditor General Dr. Ron Mwambwa from office, citing his age and lack of parliamentary ratification.

According to the petition, Dr. Mwambwa was born on August 15, 1959, making him 64 years old at the time of his appointment as Auditor General in September 2023.

LAZ contends that this exceeds the mandatory retirement age of 60 years for the Auditor General, as stipulated in Article 252(1) of the Constitution of Zambia.

The petition also argues that Dr. Mwambwa’s appointment was not ratified by the National Assembly, as required by law.

Despite this, he has continued to occupy the office and discharge its functions since 2023.

LAZ is seeking a declaration that Dr. Mwambwa’s appointment and continued occupation of the office are illegal and void.

It also wants the Constitutional Court to order that Dr. Mwambwa vacate the office of Auditor General immediately and repay all salaries, allowances and emoluments received while occupying the office.
