Two Libala South Youths Face Trial for Alleged Sexual Assault of Seven-Year-Old Girl

Two youths from Libala South, Benson Mwila and Benson Njovu, have been found to have a case to answer regarding allegations of sexually assaulting a seven-year-old girl. Lusaka Magistrate Chrispine Hampungani determined that the prosecution had established a prima facie case against the duo, aged 20 and 19 years, respectively.

The two are facing charges of unnatural offenses contrary to Section 155(a) of the Penal Code Chapter 87 of the Laws of Zambia.

According to the evidence presented, the alleged incident occurred on March 4, 2024, at Libala South, where the victim was playing with friends outside.

The victim testified that one of the accused, Benson, instructed her to follow him to an unfinished building near her house, where the alleged offense took place. The victim also stated that this was not the first time the incident had occurred.

The matter was reported to the police after the victim’s mother discovered the girl’s injuries and was informed of the alleged abuse.

The mother noticed that the girl had sores on her anus and private parts, and the girl revealed that Benson and his friend were responsible.

The victim’s mother reported the incident to the police, leading to the arrest of the two accused. The prosecution presented evidence, including testimony from the victim and medical reports, to support the charges.

In his ruling, Magistrate Hampungani found that the prosecution had established a prima facie case against the two accused, and therefore, they have a case to answer.
