Former Minister Lusambo Seeks to Settle K650,000 Debt in Instalments After Failed Property Deal

Jailed former Lusaka Province Minister Bowman Lusambo has requested to settle a K650,000 debt in installments after a failed property transaction with Zambezi East MP Brian Kambita.

In his defense filed in the Lusaka High Court, Lusambo argued that the contract was frustrated due to unforeseen circumstances, as the property became the subject of an Anti-Corruption Commission (ACC) investigation against him.

He explained that the investigation made it legally impossible to transfer a clear and marketable title to Kambita, which rendered the contract unenforceable.

Lusambo stated that he attempted to resolve the matter amicably by refunding Kambita K200,000 through an intermediary, Brian Savale.

He further contended that both parties agreed to settle the remaining K650,000 in installments and that Kambita still holds two other certificates of title as collateral.

Lusambo noted the financial impact on Kambita and expressed his willingness to repay the amount in installments, as determined by the court.

Kambita sued Lusambo, seeking a refund of K850,000 after the failed property deal.

According to Kambita’s claim, he purchased subdivision A288 of lot no. 28473/M in Lusaka from Lusambo in August 2024.

The contract stipulated that Lusambo would transfer the property title within two weeks of receiving the purchase price, and Kambita was to pay K850,000 in two installments.

Kambita said that he completed payment by September 12, 2024, but Lusambo failed to transfer the title or grant vacant possession of the property.

Despite multiple attempts to resolve the matter, Lusambo allegedly refused to fulfill his contractual obligations.

Kambita is seeking a declaration that Lusambo breached the contract, a full refund of K850,000, and damages for the breach.
