Former FAZ Vice-President Emmanuel Munaile Faces Asset Seizure Over Unpaid Debt to ZANACO

Former Football Association of Zambia (FAZ) vice-president and ex-Malole Independent MP Emmanuel Munaile is facing the possibility of losing his assets after the Lusaka High Court issued a writ of Fi Fa authorizing the Sheriff of Zambia to seize his goods to recover an outstanding debt of K423,419.45 owed to Zambia National Commercial Bank (ZANACO).

A writ of Fi Fa is a court-issued legal directive that permits a sheriff or other authorized official to confiscate and sell a debtor’s assets to fulfill a judgment.

This writ is generally issued after a creditor has successfully sued a debtor and is attempting to recover the money granted by the court.

The writ, dated January 16, 2025, commands the sheriff and bailiffs to confiscate Munaile’s property to settle the debt, which arises from a consent judgment between ZANACO and Munaile.

Court records show that the case began when ZANACO sued Munaile over an unpaid personal loan balance.

In a consent judgment signed on October 15, 2024, by High Court Judge Bonaventure Mbewe, Munaile was held liable for the full amount and was required to repay it in monthly installments of K10,000.

Under the terms of the judgment, if Munaile defaulted on any installment and failed to rectify the payment within five days, the entire remaining balance would become due immediately.

It was agreed that ZANACO was at liberty to enforce execution to recover the outstanding debt without further legal recourse. The writ orders the sheriff to seize and sell Munaile’s goods and chattels to recover the amount and return the funds to the bank.
